Amended Directive 2004/37/EC on the risks of exposure to carcinogens and mutagens at work
AbstractWith the publication of Directive 2019/130, the Directive 2004/37/ EC on the protection of workers against risks deriving from exposure to carcinogens or mutagens at work is modified.
As soon as it becomes mandatory in the Italian regulatory framework (Decree 81/2008), will have an important impact under many aspects and in several activities.
In any case needs from now on a non-trivial dynamic approach to industrial hygiene, especially on the delicate issue of CMT agents.
The changes made to the text previously in force under Directive 2004/37/EC are three:
- addition of Article 13a "Agreements of the social partners"
- modification of Annex I "List of substances, mixtures and procedures", with two new activities (skin penetration of mineral oils previously used in internal combustion engines to lubricate and cool the moving parts inside the engine; works involving exposure to exhaust emissions from diesel engines)
- replacement of Annex III, "Occupational exposure limit values", now with 21 agents.
To these are also added some announcements of further imminent regulatory developments that can be identified in the 31 Introductory Considerations, which are as usual important elements for understanding the European Union Directives
