The noise impact of the industries in the area: the activities of ARPAT in the territory of Lucca

With the adoption of the noise zoning (PPCA), the "emission limit values" and the "absolute immission limit values" have become applicable in many municipalities. These limits vary according to the acoustic class of the area. The ARPAT control activities have also been focused in the verification of their respect, but any finding of exceedance led companies to numerous disputes at the regional administrative court of Toscana. Such actions, of different origin, had in common the question of where to perform the relevant measures: if in the vicinity of the noise source or in spaces accessible by people and communities (receptors).
In this paper it is reported as the jurisprudence, within the administrative justice, sentenced in the various levels of courts. Short notes on the consequent noise action plans sometimes undertaken by companies will be shown, together with the legislative amendments n. 2R introduced by Decree of the President of the Regional Council of 8 January 2014 in matter of PCCA and noise action plans.
